PRIVACY POLICY

This Privacy Policy governs the manner in which Brand Institute and its subsidiary, Drug Safety Institute (collectively referred to as “Brand Institute,” “BI,” or “Company”), collects, uses, maintains and discloses information collected from survey takers and respondents (“Respondents”) of Brand Institute. When this is performed on behalf of clients, BI is acting as a data processor under their instruction. When BI directly collects respondent data for our own research panels or BI-initiated studies, BI acts as a controller. The Company’s use of this data in either capacity is described in this Policy.

Personal identification information
BI may collect personal identification information from you in a variety of ways, including, but not limited to, when you visit our site, register on the site, respond to a survey or fill out a form, in connection with other activities, services, features or resources we make available on our site. You may be asked for, as appropriate, your name, email address, mailing address, phone number and if you’re a healthcare professional, information about your occupation so that BI can target and tailor invitations to you to participate in surveys. You may, however, visit our site anonymously. BI will collect personal identification information from you only if you voluntarily submit such information to the Company. If you fail to provide certain personal data which Company believes is necessary to participate in the market research study, the Company may not be able to include you in the study or to evaluate your responses and include them as part of our final report. If you fail to provide your bank account details, BI may not be able to pay you for your participation in the study. Respondent participation in market research studies is voluntary and BI’s lawful basis for processing your personal data is based upon your consent. Respondents can withdraw consent at any time by telling the person who contacted them in relation to the study, or by contacting BI at the address shown at the end of this document and referencing the study in which they’re participating.

If our market research studies include children, BI will ensure we have age-verification measures in place before obtaining consent (and parental consent measures for younger children).

Non-personal Identification Information
BI may collect non-personal identification information about Respondents whenever they interact with the Company or our site. Non-personal identification information may include the browser name or the type of computer and technical information about Respondents’ means of connection to our site, such as the operating system and the Internet service providers utilized and other similar information.

Web Browser Cookies
Our site may use “cookies” to enhance Respondent experience. Respondents’ web browser places cookies on their hard drive for record-keeping purposes and sometimes in order to track information about them. Respondents may choose to set their web browser to refuse cookies, or to alert Respondents when cookies are being sent. If they do so, note that some parts of the site may not function properly.

How Brand Institute Uses Collected Information
Brand Institute may use personal information for research and development purposes to further legitimate business interests, including analyzing and improving our offered services and business operations. Specifically, we may collect and use Respondent personal information for the following purposes:

  • Our market research is conducted primarily on behalf of our clients, and occasionally we conduct market research to support our own business insights.
  • We use the data that we collect for market research purposes only, and do not use it for any other purpose without your consent.
  • We hold your name and contact details to request your participation in our market research studies and to communicate with you about the market research study. On the occasions where we hold your name and contact details, they will be deleted at the end of the research project, unless explicit consent has been obtained for us to retain them.
  • We use your demographic information to ensure you meet the market research enrollment criteria or to determine if there are differences in responses from different types of respondents.
  • We analyze and evaluate survey responses to our market research questions in order to fulfill our market research purposes, such as to understand needs, preferences, opinions or experience regarding a product, service, or to better understand future opportunities in a market, or to monitor market performance.
  • Technical data may be used to help improve user experience.
  • We use Respondent bank account details to pay Respondents for their participation in any market research surveys.
  • Brand Institute may share personal information if required to do so in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.

Brand Institute consolidates Respondent survey responses with those of other participants and reports the results to our clients in a manner that does not personally identify you. In some cases, we may report the data on an individual respondent level, but we use a pseudonym instead of your name so that you cannot be identified by our client, unless you have given your consent otherwise. In the small number of cases where we obtain your consent to share data in a manner that allows you to be identifiable, we ensure that the data will be used only for the purposes stated.

How Brand Institute Protects Respondent Information During Data Transfers
Brand Institute operates globally. When we transfer personal information from the EU, we ensure such transfers are compliant with relevant data protection laws, including, if applicable, EU Standard Contractual Clauses, or a European Commission positive adequacy decision under Article 25(6) of Directive 95/46/EC or Article 45 of the GDPR. We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our site.

Sharing your personal information
BI does not sell, trade, or rent Respondents’ personal identification information to others.

Respondents may also specifically request that their personal identification information not be shared with third parties.

NOTE: In compliance with certain privacy laws, in particular the European General Data Protection Regulation (GDPR), Brand Institute provides specific additional rights for individuals who interact with Brand Institute such as the right to access, rectification, deletion, restriction, portability, objection, erasure, blockage, to withdraw consent and to lodge a complaint. More specifically and under certain circumstances, the right to:

  • Request information about whether and which personal data is processed by us, and the right to demand that personal data is rectified or amended.
  • Request that personal data should be deleted.
  • Demand that the processing of personal data should be restricted.
  • Withdraw your consent to the processing and use of your data completely or partially at any time with future application.
  • Obtain your personal data in a common, structured and mechanically readable format.
  • Contact Brand Institute if there are any questions, comments, complaints or requests in connection with our statement on data protection and the processing of your personal data.
  • Complain to the responsible supervisory authority if believed that the processing of your personal data is in violation of the legislation.

Changes to this Privacy Policy
Brand Institute has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of our site and revise the updated date at the bottom of this page. We encourage Respondents to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of any modifications.

Your California Privacy Rights
Under the California Consumer Privacy Act, California Civil Code Section 1798.100, if you are a resident of California you may contact us with regard to the following rights in relation to your personal data: Right of Access: You have a right to request access to the personal data we may hold on you for the past twelve (12) months. You may submit up to two (2) requests per year of access to your personal data. Right to Opt-In/Opt-Out of Sale of Personal Data: For individuals sixteen (16) years or older, you have the right to opt-out of sale of personal data we may hold on you. You can exercise this right at any time by pressing the “California resident – Do not sell” link in the footer of every page. For individuals between thirteen (13) to sixteen (16) years old, you have the right to opt-in to the sale of personal data we may hold on you. Right to Deletion: You also have the right to ask us to delete personal data we may hold on you or restrict how it is used. There may be exceptions to the right to deletion for specific legal reasons which, if applicable, we will set out for you in response to your request. Right to Non-Discrimination: We will not discriminate against you for exercising any of your California Consumer Privacy Act rights.

Your Acceptance of these Terms
By contracting for services with Brand Institute or using this site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our site. Your continued use of the site and Brand Institute services following the posting of changes to this policy will be deemed as your acceptance of those changes.

Access to Respondents’ Information
Respondents may access personal identification information, on request, to ensure its accuracy.
